At EquiSmith, we treat your information the way we would want our own treated. This policy explains, in plain English, what we collect, why, who we share it with, and the choices you have. If anything is unclear, email us at support@theequismith.com and we'll explain.

1. Who We Are

EquiSmith LLC is a New York limited liability company operating theequismith.com. We are the controller of the personal information collected through the Site. You can reach us at support@theequismith.com.

2. Information We Collect

Information you give us

When you place an order, create an account, fill out a form, or contact us, you may give us: your name, email address, shipping and billing address, phone number (optional), an account password (which we store hashed, not in plain text), the contents of your order, any personalization details you submit (custom text, names, uploaded artwork or logos), messages you send through our contact form, your newsletter preferences, and information you submit on a barn application or barn-owner signup.

Information collected automatically

When you visit the Site, we automatically collect basic technical information: your IP address, browser type and version, device type, operating system, the pages you visit, the date and time of your visit, and the referring page. We use this for security, troubleshooting, and improving the Site.

Information from third parties

Our payment processor sends us a confirmation when your payment succeeds, along with limited information such as the last four digits of your card and the card brand. We never see or store your full payment card number.

3. How We Use Your Information

We use your information to fulfill and ship your orders, communicate with you about your order or account, process payments, send transactional emails (order confirmations, shipping updates, support replies), send marketing emails if you have opted in, prevent fraud and abuse, improve the Site and our products, and comply with legal obligations including tax recordkeeping.

4. Cookies and Analytics

We use cookies for essential functions like keeping you logged in and remembering what's in your cart. We also use a web analytics service to understand how visitors use the Site in aggregate. We do not use third-party advertising or cross-site tracking cookies. You can disable cookies in your browser settings, though some parts of the Site may not work properly without them.

5. How We Share Your Information

We do not sell your personal information. We share it only with the service providers we need to operate the platform, and only what each one needs:

We may also disclose information if required by law (subpoena, court order, government request) or if necessary to protect our rights, our customers, or the public.

6. Information Visible to Barn Owners

When you place an order through a barn's storefront, that barn's owner can see your name, contact information, and the details of what you ordered. This is necessary so the barn can support its customers and reconcile commissions. Barn owners are not permitted to use this information for any purpose outside the operation of their store on EquiSmith.

7. Data Retention

We keep order records for at least seven years to meet tax and accounting requirements. Account information is kept until you ask us to delete your account. Newsletter and marketing data is kept until you unsubscribe. Contact form submissions are kept for as long as needed to address the inquiry, and reasonably afterward for our records.

8. Security

We protect your information using HTTPS encryption across the Site, hashed passwords (using industry-standard bcrypt), and PCI-compliant payment processing through our payment provider. Despite our best efforts, no system is perfectly secure. If we ever experience a breach affecting your information, we will notify you as required by law.

9. Your Choices and Rights

You can update your account information by signing in to your account, or by emailing us. You can unsubscribe from marketing emails using the link at the bottom of any marketing email. To delete your account or request a copy of the personal information we hold about you, email us at support@theequismith.com and we'll handle it within a reasonable timeframe. We may need to retain some information to comply with legal obligations even after a deletion request.

10. California Residents

If you live in California, the California Consumer Privacy Act (CCPA) gives you specific rights regarding your personal information.

Categories of information we collect: identifiers (name, email, address, IP), commercial information (order history), internet activity (pages visited), and inferences drawn from this data. We collect this for the business purposes described in Section 3.

Your rights: the right to know what we collect and how we use it; the right to request deletion of your information; the right to opt out of the sale of your information; and the right not to be discriminated against for exercising any of these rights.

We do not sell your personal information. We have not sold personal information in the preceding twelve months and do not intend to. To exercise any of your rights, email support@theequismith.com. We will verify your identity before responding.

11. Children's Privacy

The Site is not directed at children under 13, and we do not knowingly collect personal information from anyone under 13. If you are a parent or guardian and believe your child has provided us information, please contact us and we will delete it. Customers between 13 and 18 must have a parent or guardian complete any transaction.

12. International Customers

EquiSmith is based in the United States, and your information is stored and processed in the United States. If you are ordering from outside the U.S., you understand that your information will be transferred to and handled in the U.S., where data protection laws may differ from those in your country.

13. Changes to This Policy

We may update this Privacy Policy as our practices evolve or as required by law. The "Last updated" date at the top reflects the current version. For material changes, we will notify you through the Site or by email.
